By purchasing lesson packages, purchasing or redeeming a gift card, or booking simulator sessions through simudrivelab.com ("Website"), you ("Client") agree to be bound by these Terms and Conditions.

1. Scope of Services

SafeStartDRV provides driving instruction utilizing simulator technology. Clients may purchase prepaid session packages (e.g., 5 or 10-session bundles). Upon purchase, session credits are applied to the Client's account for use within our online scheduling system. Please note that these simulations are for training purposes; no driver's license or learner's permit is required to participate.

2. Minors & Parental Consent

Many of our clients are students under the age of 18. If the Client is a minor, use of the Website and simulator services is expressly conditioned on the review and agreement of a parent or legal guardian. The parent or legal guardian must agree to these Terms on the minor's behalf and assumes responsibility for the minor's compliance with them, including payment for all sessions booked and adherence to the Client Conduct policy below. By providing a parent/guardian email address at registration, purchasing a package or gift card for a minor, or otherwise permitting a minor to book or attend sessions, the parent or legal guardian represents that they have read, understood, and agreed to these Terms in full.

3. Payment Terms

Full payment is required at the time of purchase. Pricing is subject to change at any time without prior notice. Price adjustments will not apply retroactively to sessions already purchased.

4. Session Credits

Each scheduled appointment consumes one session credit. Credits are strictly non-transferable and may only be utilized by the specific individual to whom the account is registered.

5. Scheduling & Availability

All appointments must be managed via the official booking system on the Website. Availability is offered on a first-come, first-served basis. SafeStartDRV does not guarantee specific dates or times and reserves the right to adjust schedules as necessary.

6. Cancellation & Rescheduling

Notice Period: To avoid forfeiture of a credit, the Client must cancel or reschedule at least 24 hours prior to the start time.
Late Cancellations/No-Shows: Cancellations made with less than 24 hours' notice, or failure to attend a scheduled session, will result in the forfeiture of one session credit.
Company Adjustments: SafeStartDRV reserves the right to reschedule any session due to technical malfunctions, maintenance, or unforeseen circumstances. In such cases, no credits will be deducted.

7. Refund Policy

All session package purchases are final and non-refundable. Unused session credits do not expire and remain available on the Client's account for future bookings, but are not eligible for a cash or original-payment-method refund. At SafeStartDRV's sole discretion, courtesy exceptions may be considered for extenuating circumstances (e.g., relocation, medical emergency) — requests can be submitted to info@simudrivelab.com, but approval is not guaranteed.

8. Gift Cards

Gift cards purchased through the Website entitle the recipient to the stated number of simulator session credits once redeemed on the Website using the provided code. Gift cards are non-refundable and cannot be exchanged, in whole or in part, for cash or any other form of payment. It is the purchaser's responsibility to ensure the recipient's email address and details are entered correctly; SafeStartDRV is not responsible for gift cards sent to an incorrect or inaccessible address. Once redeemed, the resulting session credits are subject to the same terms as purchased session packages, including the non-transferable and non-refundable provisions above.

9. Late Arrival

Sessions start promptly at the scheduled time. If a Client arrives late, the session will conclude at the originally scheduled end time to accommodate subsequent bookings. If a Client is more than 15 minutes late, the session may be deemed a "no-show" at the discretion of the staff, and the credit may be forfeited.

10. Communications

By creating an account, you consent to receive transactional notifications, appointment reminders, and service updates via email and SMS text message. You may opt out of promotional communications at any time, though essential appointment notifications will continue.

11. Client Conduct

Clients are expected to treat staff and equipment with respect. Any behavior deemed disruptive, unsafe, or destructive to the simulator hardware may result in the immediate termination of the session and the suspension of future access without refund.

12. Limitation of Liability

SafeStartDRV makes no guarantees regarding the outcome of any state-mandated driving test or the acquisition of driving skills. To the extent permitted by law, SafeStartDRV is not liable for any direct, indirect, or incidental damages arising from the use of our simulator services.

13. Coupons & Promotional Codes

Coupon and promotional discount codes may only be applied to the purchase of a single, individual simulator session at the time of booking or gifting. Coupons cannot be used toward session packages (including 5- or 10-session bundles), any multi-session purchase or gift card, or previously purchased credits, and cannot be combined with other discounts or coupons. Each coupon code may be used once per account unless otherwise stated on the offer. SafeStartDRV reserves the right to modify, restrict, or revoke coupon offers at any time.

14. Governing Law

These terms are governed by the laws of the State of Arkansas. Any disputes arising from these terms shall be resolved in the courts located within Benton County, Arkansas.

This Liability Waiver, Assumption of Risk, and Release ("Waiver") is entered into between you and SafeStartDRV LLC, doing business as SimuDriveLab ("SafeStartDRV," "we," "us," or "our"), in connection with your (or your minor child's or ward's) participation in driving simulator training sessions offered through simudrivelab.com (the "Services"). By checking the agreement box and typing your full legal name below, you are electronically signing this Waiver, which is legally binding to the same extent as a handwritten signature.

1. Who Is Signing

By signing this Waiver, you represent that either (a) you are the participant in the Services and are at least 18 years of age, or (b) you are the parent or legal guardian of a minor participant, and you are signing on the minor's behalf and agree to be bound by this Waiver both individually and on the minor's behalf. If you are signing as a parent or legal guardian, references to "you" and "participant" below include the minor participant, and you additionally agree to the obligations described in Section 5 (Minors & Parental Consent).

2. Nature of the Activity

The Services involve the use of driving simulator hardware and software intended to help participants build driving awareness, decision-making, and vehicle-handling familiarity in a controlled, non-public-roadway environment. While simulator training is designed to be lower-risk than on-road instruction, it is not risk-free. Simulator equipment includes moving seats, pedals, steering mechanisms, and visual/motion displays that can, in rare cases, cause disorientation, motion sickness, eye strain, headaches, or minor physical strain or injury. Participation also carries the ordinary risks associated with being present at a training facility, including slips, trips, and falls.

3. Assumption of Risk

You understand and acknowledge the risks described in Section 2, as well as other risks that may not be specifically identified here, and you voluntarily assume full responsibility for any and all such risks, known or unknown, arising from or related to your (or the minor participant's) use of the simulator equipment and participation in the Services. You confirm that you (or, for a minor participant, the minor) are physically able to participate in simulator-based training, and that you will immediately stop use of the equipment and notify staff if you experience dizziness, nausea, disorientation, or discomfort during a session.

4. Release of Liability

To the fullest extent permitted by Arkansas law, you release, waive, discharge, and covenant not to sue SafeStartDRV LLC, its owners, officers, employees, instructors, and agents (collectively, the "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by you (or the minor participant) while participating in the Services, or while on SafeStartDRV's premises, whether caused by the negligence of the Released Parties or otherwise, except to the extent caused by the Released Parties' gross negligence or willful misconduct. This release is intended to be as broad and inclusive as permitted by the laws of the State of Arkansas, and if any portion of it is held invalid, the remainder shall continue in full legal force.

5. Minors & Parental Consent

Many participants in the Services are under the age of 18. If the participant is a minor, a parent or legal guardian must review, sign, and agree to this Waiver on the minor's behalf before the minor may create an account or participate in any session. By signing this Waiver as a parent or legal guardian, you represent that you have the legal authority to consent on the minor's behalf, you agree to the assumption of risk and release described in Sections 3 and 4 both individually and on behalf of the minor, and you accept responsibility for the minor's compliance with SafeStartDRV's rules and instructions during simulator sessions.

6. Medical Conditions

You represent that you (or, for a minor participant, the minor) do not have any medical condition that would make participation in simulator-based driving training unreasonably dangerous, including but not limited to seizure disorders triggered by visual motion or flashing light patterns, or severe motion sickness. If such a condition exists, please contact us at info@simudrivelab.com before booking a session so we can discuss whether the Services are appropriate.

7. Photo & Video (Optional Acknowledgment)

SafeStartDRV's facility may use security or training-review cameras in common areas and simulator bays for safety and quality-assurance purposes. This Waiver does not by itself authorize use of any such footage for promotional purposes; any promotional use of photos or video featuring you or a minor participant will be separately requested and consented to.

8. No Warranty of Outcome

SafeStartDRV makes no representation or warranty regarding the outcome of any state-mandated driving test, the issuance of any driver's license or learner's permit, or the acquisition of any particular driving skill as a result of participating in the Services.

9. Governing Law

This Waiver is governed by the laws of the State of Arkansas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to this Waiver shall be resolved in the courts located within Benton County, Arkansas.

10. Acknowledgment

By checking the agreement box and typing your full legal name, you acknowledge that you have read this Waiver in its entirety, understand its terms, are signing it voluntarily, and agree that it shall be effective as of the date your account is created.
